The Department of Correction administers a Military Leave Benefit Program consistent with the laws, policies and procedures of the State of North Carolina. Leave shall be granted to employees for certain periods of service in the uniformed services. All full-time and part-time (half-time or more) permanent, trainee, probationary, and time-limited employees who are members of the Uniformed Services of North Carolina National Guard are eligible for Military Leave. Temporary, intermittent, or less than half-time employees are not eligible for Military Leave.

Military Training Leave:
The State offers Military Training Leave of 120 hours to employees that are called for Active Duty training or Inactive Duty training (annual training, drills, special schools). The 120 hours of leave is accrued on a yearly basis and available for use during the current federal fiscal year, October 1st through September 30th. An eligible employee shall be able to use any or all of the 120 hours of Military Leave when called for applicable training after all compensatory time has been exhausted.
- Request for their work schedule to be rearranged so that the drill falls on the employee's regular off days; or
- Request the use of Military Leave with pay using the 120 hrs; or
- Request the use of Military Leave without pay; or
- Request the use of Approve Leave.
* Employees are required to request this election in writing to their facility HR staff.
Reserve Active Duty Leave:
The State offers Military Leave of 30 calendar days when ordered to State or Federal reserve active duty (this refers to mobilization entitlement under state policy). Eligible employees called for reserve active duty shall be able to exhaust 30 calendar days of Military Active Duty, after all compensatory time has been exhausted first.
- To have accumulated Vacation / Bonus Leave paid in a lump sum (max of 240 hrs); or
- To retain any portion of Vacation / Bonus Leave; or
- To exhaust any portion of Approved Leave.
* Employees are required to request this election in writing to their facility HR staff.
NOTE: Other Military Leave with Pay benefits may apply such as leave for a Military Physical Examination and/or Recoup Time.
Military Leave Without Pay:
Leave without pay is granted for other Military Leave for uniformed service duty that is not covered under a paid military benefit. Military Leave without pay examples include, but are not limited to, initial active duty for training (voluntary initial enlistment), full time National Guard duty, leave time while awaiting entry into active duty to enable employees to address personal matters, duties resulting from military disciplinary actions, and inactive duty trainings.
