Medical release for inmates

On June 10, 2008 Governor Easley signed Senate Bill 1480/Session Law 2008-2 into law creating a new provision for the medical release of certain inmates.

To qualify for release from prison under this law, inmates must be permanently and totally disabled, terminally ill or geriatric as defined in the law.  The inmate must also be incapacitated to the extent that he or she does not pose a public safety risk.   Inmates convicted of class A, B1 and B2 felonies and those required to register as sex offenders under the North Carolina Sex Offender & Public Protection Act are not eligible for release under this law.  Inmates released under this law will be subject to supervision by the NC Division of Community Corrections.

The Department of Correction and the Post Release Supervision and Parole Commission are currently developing procedures for accepting and evaluating requests for release under this new law.  Further information on this procedure and how to apply for medical release will be made available on this website as it becomes available.
